General Terms and Conditions of             pd Fatbike GmbH

1. General Provisions

1.1 These General Terms and Conditions of Sale (“Terms”) apply to every purchase of products from pd Fatbike GmbHvia its online shop or any other sales channel by customers domiciled or established in Switzerland or the Principality of Liechtenstein.

1.2 By placing an order, the customer agrees to these Terms.

1.3 The offers and prices displayed on the website are for informational purposes only and do not constitute a legally binding offer by pd Fatbike GmbH.

1.4 pd Fatbike GmbH reserves the right to change prices at any time.

1.5 Customers must be at least 18 years old to purchase and operate an e-bike. Young persons aged 14 to 16 may use e-bikes only if they hold a category M driving license.

1.6 Customers are strongly advised to wear protective equipment when using an e-bike, including a helmet, gloves, and appropriate footwear, in order to ensure safety.

2. Orders and Payment

2.1 Orders are accepted only after payment has been received.

2.2 The customer must be authorized to use the selected payment method.

2.3 Prices include all applicable taxes (TTC).

2.4 Prices may vary and are subject to change without prior notice.

2.5 Payment is due at the time of ordering; changes reserved.

3. Delivery

3.1 Delivery is carried out by postal service, courier, or directly by our team to the address specified by the customer.

pd Fatbike GmbH delivers the goods ordered by the customer or provides services after acceptance of the offer. If pd Fatbike GmbH subsequently discovers an error, for example in product details, pricing, or availability, the customer will be informed immediately. The customer may then reconfirm the order under the amended conditions. Otherwise, pd Fatbike GmbH is entitled to withdraw from the contract. In the event of withdrawal, pd Fatbike GmbH shall promptly credit any advance payments made or refund them by bank transfer upon request.

3.2 The invoice will be sent by email or post.

3.3 Before completing the order, the customer may choose from various delivery options with estimated delivery times.

3.4 To the extent permitted by law, the risk of transport damage passes to the customer upon dispatch.

3.5 Every effort is made to meet delivery deadlines; however, delays may occur for which the seller is not liable.

3.6 Ownership of the goods transfers to the buyer upon handover to the courier at our warehouse.

4. Warranty

Unless otherwise stated on the product or invoice, pd Fatbike GmbH guarantees that the purchased item or any replacement product provided under warranty will be free from defects and fully functional for at least two years from the earliest date of payment, collection, or delivery.

pd Fatbike GmbH may fulfill its warranty obligations at its own discretion by free repair, replacement with an equivalent product, price reduction, or refund of the current product price.

The warranty does not cover defects caused by actions or installations not carried out by pd Fatbike GmbH, insufficient technical resources, non-compliance with installation or operating instructions, overloading of components, misuse, negligent or improper handling, or the use of unsuitable materials. This also applies to defects caused by materials supplied by the buyer.

pd Fatbike GmbH is not liable for damage caused by third parties, weather conditions, power surges, or external or chemical influences.

The warranty does not include the replacement of parts subject to normal wear and tear, including but not limited to brake pads, tires, cables, sensors, grips, or chains.

The warranty becomes void immediately if the customer or any third party not expressly authorized by the supplier makes modifications or repairs to the delivered items without the written consent of pd Fatbike GmbH. It is the responsibility of our technical staff to determine whether a defect is due to wear, other excluded causes, or a defect covered by warranty.

4.1 The warranty covers only material and manufacturing defects.

4.2 The warranty expires in the following cases:

• Products not supplied by pd Fatbike GmbH
• Insufficient or missing documentation, including missing original invoice or inconsistencies
• Products outside the warranty period
• Damage caused by improper packaging or handling during transport
• Accessories, modifications, or unauthorized repairs
• Charging with a non-original charger, deep discharge, or failure to follow maintenance instructions
• Misuse, neglect, corrosion, water damage, or exposure to extreme conditions
• Damage caused by excessive weight, stunts, or impacts
• Normal wear and tear, including but not limited to tires, brake pads, cables, grips, sensors, and chain wear
• Continued use of the product after a defect requiring repair has been identified

4.3 Any modifications to the e-bike not authorized by pd Fatbike GmbH will result in the warranty being void.

Technical specifications such as maximum speed, climbing ability, battery range, and braking performance are not guaranteed.

4.5 Proper use of the product is a prerequisite for warranty claims.

4.6 The customer must present proof of purchase and the serial number to claim warranty services.

4.7 The warranty applies only to the original purchaser.

4.8 Maximum liability under the warranty is limited to the purchase price actually paid by the customer, excluding VAT.

5. Limitation of Liability

5.1 pd Fatbike GmbH shall not be liable for personal injury, property damage, or losses resulting from improper use, accidents, or failure to follow instructions.

5.2 The company shall not be liable for indirect damages, loss of profit, business interruption, or consequential damages arising from the use of its products.

5.3 The customer is solely responsible for complying with local laws and regulations regarding the use of e-bikes, including licensing, registration, and safety requirements.

5.4 Liability of pd Fatbike GmbH is limited to the extent permitted by law.

6. Data Protection and Privacy (Compliance with Liechtenstein Law)

6.1 pd Fatbike GmbH complies with the Liechtenstein Data Protection Act.

6.2 Personal data is collected and processed exclusively for order processing, customer support, and compliance with legal obligations.

6.3 Customers have the right to access, correct, delete, or restrict the processing of their personal data by contacting pd Fatbike GmbH.

6.4 Personal data will not be shared with third parties unless required for payment processing, delivery of goods, or compliance with legal requirements.

6.5 Data is stored securely in accordance with Swiss data protection regulations and protected against unauthorized access.

7. Pre-Orders

7.1 Customers may place pre-orders for products that are not yet in stock or are sold out.

7.2 A pre-order does not guarantee immediate availability, and estimated delivery dates may change.

7.3 pd Fatbike GmbH reserves the right to cancel a pre-order if the product is no longer available. In such cases, the full amount will be refunded.

7.4 The customer will be informed of any significant delays or changes in availability.

8. Intellectual Property Rights

8.1 All website content, trademarks, logos, product descriptions, and images are the exclusive property of pd Fatbike GmbH.

8.2 Any reproduction, distribution, modification, or unauthorized use of this intellectual property is strictly prohibited without prior written consent.

9. Severability Clause

9.1 If any provision of these General Terms and Conditions is declared invalid or unenforceable, the remaining provisions shall remain fully effective.

10. Governing Law and Jurisdiction

10.1 These Terms and Conditions are governed by the laws of the Principality of Liechtenstein.

10.2 Place of jurisdiction for both parties is Vaduz, Liechtenstein. The customer waives the right to jurisdiction at their place of residence or business.
